Anti-Spam Agreement to V2NMobile Service Agreement
Spamming shall mean:
A situation where SMS are sent to Mobile Subscribers without their prior consent and/or
A situation where SMS are sent to the Mobile Subscribers encouraging them to call or send a SMS to a premium rate number and/or
A situation where the Mobile Subscribers are charged for the receipt of an SMS by the Operator and those Mobile Subscribers have not requested the SMS and/or
Any unlawful or fraudulent SMS.
V2NMobile will immediately block the customer's account if it believes that the account is being used for SPAM or unsolicited bulk messaging. V2NMobile is bound to deliver a valued service and will NOT tolerate SPAM (sending of unsolicited message) of SMS and/or ANY other kind of messages.
The customer, or users of its sub accounts, is NOT permitted to send SPAM.
If the customer does send mass SMS using V2NMobile services, it MUST comply with the CANSPAM, anti-spam legislation laid down by European Union (7(1) of Directive 2000/31/EC, by Articles 6 and 7) or any other anti spam legislation in other jurisdictions.
Failure to do so will result in immediate and irrevocable termination of your account. V2NMobile refund policy for accounts that are suspected of SPAMMING is VOID and NO refunds will be issued.
Please note that neither unsolicited messages nor any other messages that are in breach of US or international laws may be sent via the Service and that any consequences arising from the breach of US or international laws will be born by the customer.
V2NMobile does not assume any responsibility for the content of the messages the customer sends via its platform.
V2NMobile hereby underlines the customer's responsibility: The customer undertakes that it will not knowingly use V2NMobile services for any illegal, immoral or improper purpose or in any manner which contravenes the law or regulatory requirements of the appropriate jurisdiction or knowingly in any way which is indecent or offensive or in any way that could be considered as Spamming, and undertakes not to allow any third party to do so.
The customer explicitly confirms that for each SMS-MT it sends to Mobile Subscribers via V2NMobile
services/platforms, the customer has the prior consent of the recipient of each message before the message is sent.
Customer shall indemnify V2NMobile against all costs, claims, expenses and liabilities arising out of any claim, action, demand, allegation or proceeding made or brought by any person or entity (including, without limitation, any Regulator or Operator) based on
an allegation that any SMS or Transaction pursuant to an Addendum, or Customer�s use of the Services, infringes the rights of any third party or any law or regulation, or any terms directly or indirectly imposed by an Operator, including, without limitation, the Data Protection Directive (95/46/EC), the Directive on Privacy and Electronic Communications (2002/58/EC), the CAN-SPAM, the Electronic Commerce Directive (00/31/EC), the Distance Selling Directive (97/7/EC), and any national implementations, thereof, in any jurisdiction.
Customer will inform V2NMobile immediately if it has reason to believe that there is likely to be a use of the Service in any manner which would be likely to infringe this Agreement.
